A Statement of Claim is an originating process in the Court of Queen's Bench
that is used when one party is suing another party.
A common misunderstanding about the role of the Court is that the Court is
responsible for enforcing or ensuring that its orders or judgments are followed.
This is not the case. If a person is successful in obtaining a judgment
or an order in his or her favour from the Court, it is up to
that person to take whatever steps he or she considers necessary,
in keeping with the law, to enforce the order.
You can obtain a garnishing order after
you are successful in your court case and receive a Judgment.
You should refer to The Garnishment Act for more specific information.
A Small Claim Appeal must be filed within 30 days from the signing date of
the Certificate of Decision. The appeal of a Winnipeg Centre
claim is filed at Room 100 C -408 York Avenue. The appeal of
a St. Boniface Centre claim is filed at 227 Provencher Boulevard.
Small Claims that were heard in other Courts throughout the Province
must be appealed in the Judicial Centre for that Court location.
The fee is $35.00 if you were present at the hearing. The forms
you will require are available at the Court of Queen's Bench
Registry Office. If you were not present at the hearing, then
you must pay $150.00 security for costs, by certified cheque,
money order or cash in addition to the $35.00 filing fee.
