Court of Queen’s Bench - Description of the Court’s Work


The Court of Queen’s Bench of Manitoba is the highest trial court for the province. It is a court of general and inherent jurisdiction, meaning the judges of the court hear cases of all kinds and possess powers that go beyond what is conferred on them by statute. The judges are federally appointed pursuant to the Judges Act.

The court is divided into two divisions, the General Division and the Family Division.

The Family Division deals with family law cases:
     - divorces;
     - guardianships;
     - adoptions; and
     - child protection matters.

The General Division deals with all other matters, including:
    -  trials in civil matters (for example: suits in contract, accident cases, and commercial lawsuits);
     - estate/probate cases;
     - indictable (the most serious) criminal matters with or without a jury; and
     - applications for the review of decisions from certain administrative tribunals.

The court also has appellate jurisdiction and in this capacity judges of the Court of Queen’s Bench hear appeals from:
     - decisions of the Provincial Court of Manitoba in less serious criminal and quasi-criminal matters;
     - decisions of the Hearing Officers in small claims matters; and
     - decisions made by Masters of the court.
